The rules and conditions for using the Ebnexix platform.

These Terms of Use ("Terms") govern your access to and use of ebnexix.com, tutor.ebnexix.com, and the related services operated by Ebnexix ("Ebnexix", "we", "us", or "our") — together, the online and home-service tutoring platform (the "Platform" or "Service"). By creating an account, booking a session, applying as a tutor, or otherwise using the Service, you agree to be bound by these Terms. If you are creating or managing an account on behalf of a minor learner, you agree to these Terms both for yourself and on the learner's behalf, and you confirm you have the legal authority to do so.

If you do not agree to these Terms, you must not use the Service.

1. What Ebnexix is

Ebnexix is a marketplace that connects students (through a parent, guardian, or the student themselves where an adult learner) with independent tutors, for two broad categories of learning:

  • Academic Curriculum: lessons following the Nigerian school curriculum, from Nursery through Senior Secondary School (SSS 1–3).
  • Non-Academic & Tech Skills: vocational and professional skills training.

Lessons may be delivered as live online sessions (automatically recorded for later review) or as physical, home-service tutoring, depending on the option selected at booking. Tutors on the Platform are independent contractors, not employees or agents of Ebnexix — see Section 6.

2. Eligibility and accounts

  • You must provide accurate, current, and complete information when creating an account, and keep it up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@ebnexix.com if you suspect unauthorized use of your account.
  • Where a learner is under 18, their account must be created and supervised by a parent or legal guardian, who accepts full responsibility for the account and for the learner's conduct on the Platform.
  • We may suspend or terminate an account that provides false information, violates these Terms, or is used in a way that puts other users or the Platform at risk.

3. Bookings, subscriptions, and fees

  • Course/lesson bookings and subscription plans (billed monthly or yearly) are paid for through our payment processor, Paystack, in Nigerian Naira (₦).
  • Prices shown on the Platform at the time of booking or subscribing are the prices that apply; we may change pricing for future bookings or renewal periods, and will make reasonable efforts to notify active subscribers in advance of a renewal-price change.
  • A booking or subscription is confirmed once payment has been successfully verified. Access to the corresponding lesson content, live session, or booking status is granted only after that verification.
  • Refunds and cancellations are handled on a case-by-case basis — contact support@ebnexix.com as soon as possible if you need to cancel or believe you were charged in error. 4. Live sessions, recordings, and lesson resources

  • Live online sessions booked through the Platform are automatically recorded so the student can review the lesson later. Recordings are made available to the student and tutor associated with that specific booking, and to Ebnexix administrators for quality, safety, and dispute-resolution purposes.
  • You must not record, screen-capture, redistribute, or publish a live session or its recording beyond your own personal, non-commercial study use, without our prior written consent and, where applicable, the consent of the other participant(s).
  • Lesson plans, handouts, and other resources made available through the Platform are provided for your personal use in connection with your own bookings, and may not be copied, resold, or redistributed.

5. Acceptable use

When using the Service, you agree not to:

  • Provide false information during registration, tutor application, or KYC verification;
  • Harass, threaten, or behave inappropriately toward a tutor, student, or Ebnexix staff member, through the live chat/Q&A features, live sessions, or otherwise;
  • Attempt to bypass the Platform to arrange or pay for lessons directly with a tutor you were connected with through Ebnexix, in order to avoid Platform fees;
  • Use the Service for any unlawful purpose, or to upload or transmit content that is abusive, defamatory, obscene, or infringes another person's rights;
  • Attempt to gain unauthorized access to another user's account or to any part of the Platform's systems;
  • Interfere with or disrupt the integrity or performance of the Service.

We may suspend or terminate access for any user who violates this section, and may report unlawful activity to the appropriate authorities.

6. Tutors are independent contractors

  • Tutors who apply to and are approved on the Platform are independent contractors. They are not employees, agents, or representatives of Ebnexix, and Ebnexix does not control the specific manner in which a tutor delivers a lesson beyond the curriculum/subject the student booked.
  • Tutor applicants must complete our verification (KYC) process, including submitting a government-issued ID, proof of address, and relevant qualifications/certificates, before being approved to accept bookings.
  • Approved tutors earn payment for completed, verified bookings, tracked through their tutor dashboard, and may request withdrawal of their available balance to the bank account they provide.   • Ebnexix reserves the right to reject a tutor application, or to suspend or remove an approved tutor, at its discretion — including for failed verification, policy violations, or repeated student complaints.

7. Intellectual property

The Ebnexix name, logo, website, and platform software are the property of Ebnexix and its licensors, and may not be used without our prior written permission. Course materials, curricula, and lesson content created by tutors and made available through the Platform remain the intellectual property of the tutor or Ebnexix as applicable, and are licensed to students solely for personal study purposes as described in Section 4.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. While we vet tutors through our KYC and application review process, Ebnexix does not guarantee the accuracy, quality, or outcome of any lesson delivered by a tutor, and is not responsible for the conduct of tutors or students outside the scope of features we directly control. We do not guarantee uninterrupted or error-free operation of the Platform.

9. Limitation of liability

To the fullest extent permitted by applicable law, Ebnexix shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, or from the conduct of any tutor or student, whether based on contract, tort, or any other legal theory. Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to Ebnexix in the [INSERT PERIOD — e.g. "three (3) months"] preceding the claim.

Nothing in these Terms limits any liability that cannot be limited or excluded under applicable Nigerian law.

10. Termination

You may stop using the Service and request closure of your account at any time by contacting support@ebnexix.com. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unsafe conduct, or where required by law.

11. Changes to these Terms

We may update these Terms from time to time to reflect changes to the Service or for legal or operational reasons. We will update the "Last updated" date above when we do, and where changes are material, we will provide a more prominent notice (such as an email or an in-app notification) before the change takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Nigeria.
